These Terms of Service ("Terms") constitute an agreement between you ("End-User") and the developer of Genshin Timer ("Developer"), and not with Overwolf Ltd. The Developer, not Overwolf, is solely responsible for the App and its content. By installing or using Genshin Timer, you agree to these Terms.
You and the Developer acknowledge and agree that Overwolf Ltd. and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Overwolf will have the right — and is deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, revocable, non-transferable, non-sublicensable, worldwide license to use Genshin Timer solely for your personal, non-commercial purposes. You may not copy, distribute, modify, reverse-engineer, or create derivative works of the App.
All intellectual property rights in the App are owned by or licensed to the Developer. You and the Developer acknowledge that, in the event of any third-party claim that the App or your possession and use of it infringes a third party's intellectual property rights, the Developer — not Overwolf — will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Your use of Genshin Timer is at your own risk. The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law. The Developer does not warrant that the App will be error-free, uninterrupted, or free of harmful components.
The Developer is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. Overwolf has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
The App is provided free of charge. The App and any advertisements displayed within it may involve linking to or using websites and services belonging to third parties. The Developer has no control over such third-party sites and is not responsible for the content or services available through them. All use of third-party sites and services is at your own risk, and the Developer does not endorse any products or services offered by third parties. You must comply with any applicable third-party terms of agreement when using the App.
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the App, even if the Developer has been advised of the possibility of such damages.
The Developer reserves the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
